En Primeur event 2025
This comment is in reference only to a recent "En Primeur" purchase. I had many other experience with this shop that were excellent, with professional people.
In this case, the "En Primeur" event was offering "exclusive campaign prices" for the 2024 Bordeaux vintage. Prices were clearly advertised and many Chateaus representatives were on the event, promoting their wines. After the event, I made an order of different wines, and the order was accepted and payment was processed. This constitutes a binding sales contract under Danish contract law (Aftaleloven) and the Consumer Rights Directive (Directive 2011/83/EU) as implemented in the Danish Consumer Contracts Act (Forbrugeraftaleloven).
However, a few weeks after the purchase, the wine shop sent me an email, stating that they could not get the product from one of the producers for the price that it was stablished. There was no mention of "printing errors" or "reservation availability".
The refusal to deliver the wines at the advertised and agreed prices may constitute a breach of contract and a misleading commercial practice under the Danish Marketing Practices Act.
There were some forth and back emails to the sales agent, which in my opinion, were unprofessional from his side. As a result of the arguments, and for my lost of trust in the shop, I decided to cancel my entire order. The money was refund.
When you buy "En Primeur" you have to absolutely trust your supplier. You are buying something from the future, and you wish them to be transparent and committed to the client. I don't feel like that anymore with this wine shop.
