Their lie cost us £300

Two reasons why I don’t recommend Martin & Co Truro:

Firstly, when myself, my partner and two friends rented a home via this estate agency, my partner and I asked permission to paint the wardrobe to brighten it up a little because it was looking old and tired. We were assured this would be fine, it wouldn't be a problem, that the landlady would be fine with it and that there was the possibility of the entire wardrobe being removed once we left anyway. We were PROMISED this would not be a problem. After we moved out, we got our deposit information from Martin & Co. and were informed they were claiming the better part of £300 as "someone had painted the wardrobe". We were shocked and livid, OF COURSE SOMEONE PAINTED THE WARDROBE YOU TOLD US WE COULD. We replied and said our negotiator at the time had assured us this would be fine and not an issue in any form. The estate agent replied and told us they had no idea of this and the "Negotiator" had told no one, not written this down and not even told the landlord of this. So there went £300 we felt we really shouldn’t have to pay.

Secondly, I decided in January 2020 before Covid hit the UK that I would be moving out of the property and informed Martin & Co. early that the tenancy wouldn't be extended past its contract. In March, I further informed Martin & Co. that, regardless of the pandemic, I was still moving out on July 12th (the tenancy end date) as planned. Fast forward to June, my housemates were having trouble finding a new home and they asked Martin & Co. to extend their contract past July so they could continue to look for a new home – they explained it would not include me.

Once this was ‘settled’, I discovered Martin & Co. had added me into the new contract. I emailed the estate agency to explain I no longer lived there, I didn't want to be on the new contract and I didn't agree to be on it. I insisted to be removed right away. They replied saying was nothing they could do and that I was stuck on the it (keep in mind that my partner had moved out in Nov 2019 and they had NO ISSUE AT ALL REMOVING HER FROM THE CONTRACT AND REPLACING HER WITH OUR NEW HOUSEMATE) So I was on a contract I never agreed to, never signed and never even read. Whenever I emailed them asking for them to fix this, I got a passive aggressive "No".

Basically, I was (and still am) furious. In a nutshell, they lied to us to get us to move in, their lie cost us £300, then during a global pandemic they added me to a contract I didn't agree to and refused to remove me. Horrible experience. Definitely don’t recommend.

Thank you for taking the time to write a review and I am sorry that you feel aggrieved with the situation.

I would like to address the two points you have raised if I may, just to clear the air.

1. It is quite a big thing to paint a pine wardrobe black! Sadly just don’t have any record of a conversation between yourself and anyone who works for the company about the wardrobe. The negotiator you mention also disagrees that any permission was given. As there is no record and you haven’t been able to provide us any evidence we have to follow the landlords instructions and propose a deduction from the deposit. The DPS are now arbitrating the case and we will wait for their decision. Again, it isn’t us asking for the cost here, the landlord has requested it and we have to take their instruction

2. You are quite correct that you told us that you were moving out, however we did clearly explain that you were in a joint tenancy with your other housemates and you couldn’t just walk away from the contract. I know you and I had a conversation several times to try and explain this to you and I am sorry if you still didn’t quite understand. The other housemates wanted to stay on and thankfully covered the rent on their own but the contract continued in all of your names and only ended when everyone moved out. This is not our rule, it’s the law I'm afraid.
