Dear Rafael,
We understand that it was extremely disappointing for you that the property was ultimately not sold to you. However, the accusation that Makelaarsland acted in an “untrustworthy” manner is serious and, in our view, entirely unjustified.
At the time a new and higher offer was received, there was no purchase agreement signed by both parties. As the selling agent, we are required to present such an offer to our client, the seller. It is then up to the seller to decide how to proceed, within the applicable laws, regulations and NVM guidelines.
The seller made a decision in this situation. As the selling agent, Makelaarsland represents the interests of the seller and is required to respect the decision made by our client. We fully understand that the outcome was very disappointing for you as prospective buyers. However, that does not make our actions incorrect or untrustworthy.
You were represented in this process by your own buying agent. It is precisely the role of a buying agent to represent the buyer’s interests, explain the buyer’s legal position as long as no purchase agreement has been signed, and provide timely and clear guidance about how the process works.
We therefore find it particularly regrettable that you have chosen to publish such serious accusations about Makelaarsland on multiple public platforms, while we acted in accordance with our obligations as the selling agent. Disappointment with a seller’s decision is understandable, but in our view it does not justify publicly portraying Makelaarsland as untrustworthy.
We once again ask you to discuss the course of events with your buying agent and, based on that explanation, reconsider this review and the accusation made in it.
Kind regards,
Mitch Geurtsen
