Pinder Wrongful Tree Report

In Aug2023 tree surgeon David Cook confirmed his friend arboriculturist Andy Pinder would make Tree-climb Full Inspection+Report on our 3-4 storey high Robur Oak for £400+VAT +In Oct fixed 9thDec date for them both to come - only for Andy to cancel it on Dec8th +no new date in sight.
Jan2024 I was very alarmed by one high up stump+own-branches becoming visibly more dangerous +capable of falling onto 2 adjacent properties. So I Notified Wandsworth LPA of this in PlgApp 2024/0217 on 22Jan as described in my Wandsworth LPA review of 27Feb including a bad Andy LIE that our Oak is NOT in a Conservation Area - which it certainly IS!
I thought Andy+David's visit on 9th Feb was to decide when to deal +stump first then arrange our next steps. However, they laughed at the few moments they allowed me to say ANYTHING + ignored all dangers re neighbours +St.Cecilia's School new classroom block being so close within the Built Environment of our Tree; merely suggesting to light prune parts of the crown - which would be inappropriate and pointless.
I was so upset by this that I emailed both men that day asking Andy to answer safety questions PRIOR to writing anyReport. He ignored me so 12Feb I emailed asking him NOT to write Report at all. He ignored again +emailed his Report to me on 21Feb but dated 13Feb.
So my brief COMMENTS TO ANDY re HIS REPORT STATEMENTS are:
* I did NOT agree to have 'fait accompli' Report at this stage +NO fee was discussed for ground-view Assessment.
*I paid your £175 bill to prevent aggro. and the REPORT IS UNUSABLE.
* WHY did you LIE that "Mr Tirimo" had expressed his own worries re the Oak? My son Francesco T has never examined it + only spoken to me about it. And my Ex Martino T has not seen it for 26 years.
* I did NOT give you a "Clients Brief" as you gave me no chance to do so!
* Oak does NOT have "surrounding" close built residential properties. Only 25+27 Sutherland Grove semis in East + School in North sides.
* You OMIT mention of high ground water soggy, worm-muddy, marshy lawn since new-builds + Horse Chestnut loss in 2021 as possibly becoming a long-term problem to affect the Oak.
* Oak's c.3-4 storey huge height likely to be more than your 22metre guess and you OMIT the hugely important "Target" of St.Cecilia's School close classrooms building.
* Your "scratching by squirrels" in "image showing squirrel activity" is surely the canker stain which runs down from c.half-way up Oak from the dangerous stump itself? + the foreground sticks at base of stem have never been there! So it must be doctored photo.
* You OMIT mention of Weeping Canker from the stump in "location of failed scaffold limb repair treatment" photo. Honestly, how could you have missed that? Let alone fail to point out how dangerous that stump is - the photo having been darkened +not taken from best angle to show all the cracking bark and soft rotted wood.
* You OMIT surely that squirrels dray is at top of Tree out of sight +I could've told you how active they are eg stripping bark of many branches if you'd not avoided me! And "displaced wall image" was completely caused this century by large men sitting and walking on it to work on sheds roofs etc +cut low Oak branches as well as foxes having hurled themselves up + over it!
All in all I DON'T wish now to carry the legal responsibility for the enormous tree-like limbs in the upper crown - especially where they hugely overhang Nos.25+27 S.Grove. A thorough Tree-climb Inspection +Report etc is needed more than ever. Yet it appears that both LPA +local + international stakeholders of the 2A +Area Masterplan wish the Tree to fail completely. Who can I trust when all who try to work here receive interference from them in continuing attempts to bankrupt us out of our home.
