Monday, Oct 12, 2026, my husband and I went to Tomball Dodge to view vehicles. We owned our trade-in vehicle, a 2023 Cadillac XT6 Luxury, outright with a clear and free title.
The sales rep explicitly stated, "You have 3-days", leading us to believe we could bring the truck back if we had any problems or changed our minds. Relying entirely on this verbal guarantee and material misrepresentation, we signed a contract for a 2026 Ram 2500 valued at approximately $55,000, and the dealership valued our clean Cadillac trade-in at an undervalued $25,000.
Upon driving the heavy-duty Ram 2500 home to Waco, we quickly realized the vehicle was fundamentally too massive and posed a physical safety hazard for my husband and I to operate and get in or out.
Wednesday, Oct 14, 2026 (43 hours later), my husband and son returned to Tomball Dodge to exercise the return guarantee and swap the contract to a smaller, safer, and less expensive vehicle on their lot.
The Used Car Manager and dealership staff completely refused to honor the 3-day guarantee, stated that Texas law did not require them to help us, and falsely claimed our Cadillac trade-in was "already gone" in less than 43 hours. My husband refused to accept the unsafe vehicle, placed the keys on the showroom desk, and officially refused physical delivery of the Ram 2500, some of the dealership staff subjected him to intense hostility and verbal intimidation. A manager explicitly threatened my husband, stating that if we left the truck on their lot, they "wouldn't be able to help it if something happened to it, like it getting broken into or worse."
Due to this hostile environment and safety threats, my husband and son abandoned the Ram 2500 and its keys safely on the Tomball Dodge property and checked into a local hotel. We filed a dispute with the lender and complaints with the Texas Attorney General and TxDMV to investigate Tomball Dodge for deceptive trade practices (DTPA violations), bait-and-switch tactics, and consumer intimidation. We demand that Tomball Dodge unwind this fraudulent contract, return our 2023 Cadillac XT6, or restructure the contract fairly for the smaller $38,304 Ram 1500. Furthermore, my husband requires the use of a walker for physical mobility and safety. During the verbal dispute on Oct 14, dealership management explicitly threatened to have my son arrested simply for standing in the showroom and assisting his father with his walker. This constitutes severe consumer intimidation, malicious coercion, and harassment of a physically disabled consumer and his caregiver.
