The cookie banner on The Sun is a textbook example of manipulative design that appears to undermine the spirit, if not the letter, of UK GDPR and the Privacy and Electronic Communications Regulations. Presenting "Pay to Reject" as the only immediate alternative to "Accept" creates a coercive pay-or-consent dynamic, while burying the actual rejection options behind extra clicks and visually prioritising "Accept all" over "Save and exit" strongly suggests the use of dark patterns. Consent under data protection law must be freely given, specific, informed and unambiguous, and when rejecting tracking is made deliberately harder than accepting it, that standard is highly questionable. This approach feels intentionally deceptive and disrespectful to users’ autonomy, prioritising advertising revenue over transparent and fair data practices.
