Renters BEWARE

Renters BEWARE. This company will try to swindle you out of money that you don’t owe! They claimed we broke a headboard and charged us $400 when we had photographic evidence that the bed was in perfect condition when we left. They didn’t care, they only cared about. Trying to squeeze us for more money. Completely immoral.

Refusing to refund during pandemic:

In order to avoid liability for breach of the contract (by violating the cancellation policy) one must demonstrate some legally recognized excuse to defend the breach. The most obvious excuse in this situation is that the renters found it impossible to perform (e.g., occupy the property and pay for that use), because of circumstances beyond their control due to the public health risk. This kind of circumstance is sometimes called a “force majeuere.” The contract may say something about it. But assuming it does not, the law would say the renters’ failure to perform was excused by legal impossibility. The policy is that one should not have to choose between honoring the contract on one hand, or facing a dangerous prospect of catching a deadly contagious disease (or even spreading it), on the other hand. Therefore the contract may be set aside, and the non-performance excused, leaving the renters in a position they were in before the contract.
