Avoid at all costs - scam artist
My husband and I ordered 11 boxes of wine on 8th December to be delivered to Ireland and paid just under €155 for it. We advised LABOXAVIN that we needed the wine for Christmas and were told there should be no issue.
Fast forward to 15th Dec, UPS promised us delivery, which never happened. We changed the delivery address to a new pick up point as we would not be at home during the day and were told it would arrive on 22nd December. This date also passed, with no update, despite contact with LABOXAVIN and their carrier, UPS.
We were repeatedly told "we are looking into it" yet neither LABOXAVIN or UPS thought to tell us 23rd December was the last delivery date before Christmas. We kept emailing, but the responses just stopped and we heard nothing until I followed up again requesting a refund, which I am entitled to under EU law, as the goods were not received and we had informed the supplier we needed them by a certain date.
UPS proceed to tell us on 27th December that 12 bottles were received and 2 were damaged and that they'd deliver them all to us. LABOXAVIN responded, asking us to take carriage of the damaged items and advising that it was our responsibility to pay for postage to return the damaged bottles to them, before the would refund us. I refused to take carriage of a damaged and incomplete item. Again, under EU law, consumer must be refunded within 14 days if goods are damaged. Also - putting your hand into a box containing broken glass? Health and safety anyone? They also refused to refund the €280 I had to pay to replace the undelivered wines.
When I quoted my rights under EU law, I was asked for my bank details and told a refund would be made.
5 days later, no refund from LABOXAVIN and UPS then proceeded to deliver the package on 3rd January, forging my husbands signature as having taken the package. Fortunately, we have CCTV footage which shows the driver arriving in an unmarked van, knocking at the door to which there is no answer, then scanning the package and leaving.
When I arrive home, I have an update from UPS advising my package was delivered yet there is no package at my door. I contact LABOXAVIN and advise them no refund has issued and they advise me they have "conclusive evidence" we received the package in the form of the forged document "signed" by my husband who was not at home.
I share the CCTV from my home with LABOXAVIN, which clearly shows the driver knocking and no answer at the door of my home and then him scanning a box and advise them that this was not where the package was due to be delivered and that upon arrival home, there is no package, so all I can assume is that someone took it from the time it was delivered to the time I arrived home.
No reply from LABOXAVIN despite them breaking EU law. I am now in the process of filing a claim with the EU small claims court.
Neither LABOXAVIN or UPS should be allowed to continue trading - I have never in my life been scammed or lied to so much.
EDIT; In relation to the response to my review, this a blatant lie and we have video proof to refute their allegations.
EDIT; Clearly LABOXAVIN do not look at the videographic evidence which proves their delivery partner forge signatures to mitigate any liability. See you guys in the EU Small Claims Court!
EDIT; Full refund provided by our bank due to non delivery of items that were 'delivered' according to Laboxavin and UPS. We provided our bank with the video proof that no delivery was received and that Laboxavin allowed their delivery partner to forge my husbands signature. Laboxavin didnt have the decency to respond to our bank or our official letter of complaint - what a joke! We will never use either of these shambolic vendors again and advise all to steer well clear.
