Unacceptable Errors and Overbilling in a Simple Mediation

Kyle Cunningham was pleasant enough; however, the overall quality of service and level of professionalism were disappointing.

My ex-husband and I were present for just over three hours total. Approximately one hour was spent separately explaining the mediation process to each of us, and the actual mediation itself lasted roughly 30 minutes. Despite this, we were billed for five hours.

We waited more than an hour while Mr. Cunningham corrected numerous typographical errors in our court documents—errors that should never have occurred. My first name was misspelled in multiple places, my ex-husband was incorrectly listed as “Jeffery” instead of Trent, and several documents reflected the year as 2025 rather than 2026. Correcting these mistakes took longer than the mediation itself.

The billing process was equally frustrating. The invoice was issued in my ex-husband’s name, leading me to believe it reflected the total charge rather than my portion. The invoice did not include an office phone number, requiring me to search online to contact the office for clarification. When I called, the secretary was dismissive and rude when I questioned the additional two hours billed. Even the invoice itself contained typographical errors.

As an attorney, I expected Mr. Cunningham to be prepared and to use basic quality controls such as spell-check or document review. Charging $2,237.40—including $156 in photocopying fees—for time spent correcting avoidable mistakes is unreasonable. This was a straightforward, one-time exchange, which Mr. Cunningham himself described as easy and fast.

Fortunately, my ex-husband and I had no disputes to resolve. Had the situation been contentious, I would not have felt confident in Mr. Cunningham’s mediation abilities.

There is a Kyle Cunningham based out of Missoula that does Family Law, who might be who you are trying to reach. I’d encourage you to double-check the firm and attorney name so your concerns get to the correct place.

Worst law firm - not knowlegable

I Hired Law Firm
Worst law firm.
Not responsive via email or phone.
They do not respond to your emails.
They do not return calls
They lag and do not finish.
No one in office - calls forwarded to answering service or call center.
If you have something that needs to get done, they can’t or won’t finish.
They take your retainer and leave you hanging dry.
How long should it take for an attorney to answer an email?
Seven days and counting - still no response. Even a follow up email has not received a response.
They make their money by you missing your deadline and then ‘do more work’ and charge you more.
Really don’t know why they don’t return correspondences. Will need to report the firm to the State Bar.
I may die before they finish the simple trust.
4 months and still dragging on.
