Cosgrave Oil Refund Fraud

Absolutely disgusted by Paul Cosgrave of Cosgrave Oil Limerick who have withheld my full deposit illegally.

Escalated the issue to the Manager, Paul Cosgrave (picture attached) and you can see his response to my emails when requesting my full refund when Cosgrave Oil Limerick advised they could not deliver to my Eircode.

In Ireland, a business cannot legally deduct transaction fees from a refund when the consumer is exercising their statutory consumer rights within a 14-day cooling-off period. I was entitled to a full reimbursement of all payments made, including any charges incurred by Cosgrave Oil & their payment provider (Whoever they may be).

Cosgrave oil should not be accepting any payments if it cannot deliver to an Eircode. However Cosgrave Oil are happy to accept payments and then withhold customer's full refunds. We cannot be held responsible for your incompetent website or lack or Eircode checks for delivery purposes. I am NOT responsible for your charges incurred as per your contract between Cosgrave oil and Stripe.

These costs are incurred by YOU the business and Cosgrave oil are NOT allowed to pass on or deduct your transaction costs from the consumer (myself).
I strongly suggest that Cosgrave oil hire someone who can read the Irish Consumer Rights Act 2022 and the Consumer Rights Directive (which governs online sales). Which clearly state that deducting transaction fees is not permitted under law and I (the consumer) can request the full outstanding amount.

Paul Cosgrave's response sums up Cosgrave Oil Limerick, which is to belittle, bully & harass any customers who exercise their legal right to a full refund as per Irish law. Absolutely disgusting behaviour by a company who claim to be a “trusted local business” who pride themselves “on building lasting relationships with customers, grounded in trust and reliability”. How can you trust a business which flouts the law and invites legal action despite knowingly breaking Irish consumer law.

Also doesn’t seem I’m the only one Paul Cosgrave company has potentially defrauded, other reviews backup my claim also.

Caution - Fraudulent Company!

Caution - Now seems to be a Fraudulent Company!
I have used this oil company previously with no issues, but today when I ordered oil, I received notification that my online order completed successfully. Shortly afterwards, I was notified by email that they would not deliver to my address in Clare and were withholding some of my refund, having paid in full. Ironically, my address processed without issue and their site lists Clare as a service location. I now have to start proceedings with my bank to get the remainder of the money that I paid to this company.
Beware Fraudulent Company!
